2. Purpose, categories of personal data, legal basis and retention
2.1 Categories of your personal data and purposes of our processing
We process the following categories of your personal data for the following purposes:
We only receive name, address, telephone number or e-mail address if you wish to make direct contact with us or register for a demo. Which data is collected in the various entry masks depends on the individual entry fields. Mandatory information fields will be marked accordingly. All other information shall be voluntary.
Further personal data is only collected automatically on this website to the extent that it is technically necessary. Under no circumstances will the collected data be sold or passed on to third parties for other reasons. We automatically collect and store the server log files information that your browser sends to us.

- Host name of the accessing computer (IP address)
- Referrer URL (the previously visited page)
- Browser type/version of the user

This data is solely used by us for the purposes of data security, for statistical evaluation and for the design of the website in line with requirements based on the legitimate interests of us within the meaning of Art. 6 para. 1 lit. f) GDPR. An allocation of this data to a specific or determinable natural person is neither carried out by us nor by third parties on our behalf. This data is not merged with other data sources. No personal user profiles are created.

The legal basis for processing of personal data for personalized services is Art. 6 para. 1 lit. (a) and (b) of the GDPR permitting the processing of your personal data for the purposes of providing our personalized services to you.
2.3 Do you have to provide your personal data to us?
The provision of your personal data is necessary to access the protected areas of this website which is limited to members of our customer groups, to make direct contact with us, to receive a Newsletter. This means that you are obliged to provide your personal data to us as part of a user registration process when making use of these options. Such personal data remain under your control at all times via the “My Profile” facility, in so far, you are a registered user on our website. Your user account can be viewed or modified at any time by you, the account owner.
The consequences if you do not provide your personal data to us are that the respective service offered may no longer be available.
2.4 Do We make automated decisions on you?
Except for automated processing, including profiling, we do not make any automated decisions which produce legal effects concerning you or similarly significantly affect you.

Otherwise, your personal data will be stored exclusively in our database and on our servers, or on those of our commissioned data processing providers.
In order to provide our contractual services, we make use of selected service providers (contract processors) and vicarious agents in the categories listed below, who can obtain access to your data to the extent necessary in each case and use them to fulfil the tasks commissioned by us.
Under these conditions, the recipients of your data may be other companies and service providers (contract processors) / vicarious agents in the following areas: web statistics, newsletter and mailing services.
If you contact us by means of one of our contact forms, the collection, processing and use of your voluntarily provided contact data (e.g. name, e-mail address) is only carried out for the purpose of recording and answering or processing your enquiry and for statistical purposes on the basis of Art. 6 Para. 1 lit. b) and f) GDPR. If we no longer need your data for these purposes, we will delete them. The data you enter in the form will be transmitted encrypted (SSL).

4.2 Borlabs Cookie and Cookie Management
We use Borlabs cookie on our website, which sets a technically necessary cookie (borlabs cookie) to store your cookie consent. Borlabs Cookie does not process any personal data.

6. Webinars with GoToWebinar
To conduct webinars with interested parties and customers, the European Energy Exchange AG uses the software GoToWebinar provided by LogMeIn Ireland Limited (contract processor). Personal data is collected/stored as part of the registration process on LogMeIn’s infrastructure (Bloodstone Building Block C70 Sir John Rogerson’s Quay Dublin 2, Ireland). In particular, this includes last name, first name, company, telephone number and email address. The legal basis for data processing is Art. 6 para. 1 lit. b of the Basic Data Protection Regulation.
The processing of the data by LogMeIn (as a processor) is based on Article 28 of the Basic Data Protection Regulation. The data is processed within the legally permissible scope in Germany, the European Union and the USA. For data processing in the USA, an adequate level of protection has been established by agreeing to the EU standard contractual clauses. The deletion of the data is carried out in accordance with the legal retention periods.
The EEX Energy Exchange will only use the data for a purpose other than the aforementioned purpose of contract fulfilment or transfer to other third parties if this is legally permissible or the user has expressly consented.

- to restrict or object to its processing;
- to tell us that you do not wish to receive marketing information; and
